CONTRACT:
Contract
dated January 4, 1932, whereby Reese B. Brown and Sadie R. Brown, his wife, sold to W.H.
Moss and Sarah D. Moss, his wife, of Tazewell County, Virginia, who agreed to purchase, 4
certain tracts or parcels of land described as follows.
#1
One tract containing 333.9 acres, situate in Burkes Garden, Tazewell County,
Virginia, known
as the F. M. Moss place, and the other tract situate on the north side of
Rich Mountain, in Tazewell County, Virginia, near the top, on the waters of Clear Fork of
Wolf Creek, containing 15 acres, more or less,
and being the same two tracts of land which
were conveyed to party of the first part by S. B. Ward and wife, by deed dated December
29, 1931, to which reference is made.
#2 A tract of land, situate In Burkes Garden,
Tazewell County, Virginia, containing 102.6 acres, known as the John H. Thompson lands,
and another tract, situate in Burkes Garden, Tazewell County, Virginia, containing 160.96
acres, known as the George W. Moss lands; and, also, all the livestock, farm machinery and
personal property of every kind and character then on said land, and being the same two
tracts of land and personal nroperty which was conveyed to said parties of the first part by A. W. Davis, by deed dated
December 29, 1931, to which reference is made for the aggregate purchase price of
$75,047.00, of which $5200.00 is consideration for the
personal property above mentioned, and the remainder, $69,847.00, is consideration for the
said 4 tracts of land. Said purchasers agree to pay said $75,047.00 twenty-five years
after date of said contract and agree to bind themselves to pay annually 5% on said
purchase price of $75,047.00; all taxes to be paid by party of the second part; amount
unpaid on said purchase price being $75,047.00,
plus interest from January 4, 1933 . . . . .

In the Probate of Reese Bowen Brown who lived and died in Yakima. Reese purchased these 4 parcels in the previous
year and sold them on January 4, 1932. Reese
was a great great-grandson of Low Brown and great grandson of Ambrose Hall. Reese died January 27, 1934. Reese was born in Tazewell County on February 20,
1882.
In the 1930s
Reese returned to Burkes Garden and erected a stone wall around the Brown/Hall
Cemetery, which is located at the east end of Burkes Garden, just off the back road.
I am curouis if any of these 4 tracts are that same property? I believe the
cemetery property is in the Thompson family, today.
It is
my belief that the W. H. Moss is William Harden Moss and his wife Sarah Harless Davis
Moss. The F. M. Moss place was most likely,
William Hardens uncles place, Francis M. (Frank) Moss, who was a twin brother
of Williams father , George W. Moss. A.
W. Davis was most likely Addison Wynne Davis, who was Sarah Harless Davis Mosss
uncle. The S. B. Ward mentioned may
have been Samuel Benton Ward, who was a 3rd and 4th cousin to Reese
Bowen Brown. Sarah Harless Davis Moss was
Reeses 2nd and 3rdcousin. At the time of his death, Reese Bowen Brown owned
nearly 100 head of registered Hereford cows and bulls that were pastured in Burkes
Garden.
